In consideration of being permitted to participate in athletic training, conditioning, and sports performance activities (the "Activities") provided by H.E.A.T. Athletics, Travis Hugg, and any affiliated coaches, contractors, agents, and assigns (collectively, "H.E.A.T."), I — the undersigned participant or parent/legal guardian of the minor participant — acknowledge and agree:
1. Assumption of Risk. The Activities involve physical exertion and equipment use and carry inherent risks including strains, sprains, fractures, concussions, heat illness, permanent disability, and death. I voluntarily assume all such risks, known and unknown, including those arising from H.E.A.T.'s negligence.
2. Physical Condition. The participant is in good health and fit to participate. I will disclose all relevant medical conditions and keep H.E.A.T. updated.
3. Release & Waiver. I release, waive, discharge, and covenant not to sue H.E.A.T., its owners, coaches, employees, contractors, and facility hosts from any liability, claim, or cause of action arising out of participation in the Activities, including claims based on negligence.
4. Indemnification. I will indemnify and hold harmless H.E.A.T. from any loss, liability, damage, or costs (including attorneys' fees) related to participation.
5. Emergency Care. I authorize H.E.A.T. to seek emergency medical treatment for the participant and accept financial responsibility for such care.
6. Governing Law & Signature. This agreement is governed by the laws of the Commonwealth of Virginia. Typing my name below constitutes my legal electronic signature and is binding.
